Some PILs filed by local residents want dumping grounds to be shifted because of the foul smell they produce. Bhadang made it clear that it is issuing Plastic Outdoor Manufacturers drastic directives as it had come to the conclusion that neither the state government nor municipal corporations were going to do anything to resolve the issue of solid waste management, which is causing serious health issues for citizens.The judges expressed dissatisfaction over the fact that the government had failed to implement MSW Rules, which came into force in 2000, till date despite repeated high court directives.The division bench of Justice Abhay Oka and Justice C. Though the HC excluded redevelopment projects from the restrictions, it also said that even redevelopment projects could not be given additional FSI. CC is needed for commencing any construction work while IOD is the list of conditions that need to be complied with before starting the construction. However, in redevelopment projects too no additional FSI will be permitted, without which it is highly unlikely that any developer will come forward for the project.V.The Bombay high court on Monday directed the BMC not to give a new permission to any new construction of commercial or residential building in the city till all the rules of solid waste management are complied with.These restrictions will not be applicable for proposals of hospitals, dispensaries, educational institutions and redevelopment projects. The court was hearing a bunch of PILs alleging that solid waste management rules are not followed at the dumping grounds, leading to pollution.The HC bench said that while the BMC can process the proposals for new buildings, but it will not issue commencement certificate (CC) and intimation of disapproval (IOD) to any projects. The HC has also prohibited the state from making any changes in DC rules to allow additional FSI in the future till it complies with SWM rules. The restrictions will be in place till the time the BMC complies with Municipal Solid Waste (Management and Handling) Rules, 2000. The rules regarding solid waste management came into force 16 years ago, but the government and BMC has done nothing to implement them. Hospitals and educational institutes have been exempted from the restrictions..
